Deportation Procedure for Indian Nationals detained in Malaysia

(1). Transfer to Immigration Detention Depot

After release from prison, individuals are usually transferred within 1–2 days to the nearest Immigration Detention Depot. Malaysia has over 20 detention depots and 40 prisons.

(2). Travel Document (if passport is missing)

• Immigration authorities contact the High Commission if the passport is lost or unavailable.
• This request is usually made immediately after transfer from prison to depot.
• The High Commission issues an Emergency Certificate (EC) after verification of Indian nationality and sends it to the Immigration authorities within one week after receipt of request from Immigration authorities.

(3). Arrangement of Air Ticket (if passport is available)

• If a valid passport exists, immigration authorities may contact the family to arrange an air ticket.
• At times, such information comes through an agent/third person, who asks for remitting the fund for purchase of ticket rather than providing an air-ticket.
• Families are advised to purchase the ticket directly and share the copy with immigration authorities.

(4). Request for ticket received in High Commission

• If requested by immigration authorities, the High Commission contacts the family to arrange the ticket.

(5). Deportation Schedule

• Each detention depot usually has only 1–2 deportation days per month. Ticket should be purchased only after the deportation date is confirmed by the concerned immigration authorities to the family of a detainee directly or through the High Commission.
• Missing a scheduled deportation date due to lack of air-ticket results in waiting for the next available date.
