Procedure for Recruitment of Indian Workers
All the Foreign Employers (FEs), who seeks to recruit Indian workers, need to register in the eMigrate system (www.emigrate.gov.in). The duly filled-in registration application will then be vetted by the Indian Mission. Thereafter, the Foreign Employers can raise the demand for Indian workers on the eMigrate system and seek a permit to recruit directly or select Recruiting Agents in online manner. Such FEs shall be required to declare the terms and conditions of employment of each category of the job at the time of applying for the demand registration. The declared terms and conditions of employment will act as a specimen contract and will form the part of employment contract at the time of actual recruitment. The procedure to fill the online form has been explained through videos in the Resources tab of the website (www.emigrate.gov.in)
The implementation of new system will be done in phases:
a) FEs recruiting more than 150 Indian workers are required to register online with immediate effect in order to raise demand and seek a permit to recruit directly or select RAs. |
b) FEs recruiting between 50-150 Indian workers are required to register online with effect from 1 July 2015. |
c) FEs recruiting between 20-50 Indian workers are required to register online with effect from 1 August 2015. |
d) FEs recruiting less than 20 Indian workers are required to register online with effect from 1 October 2015. |
In addition, a provision for applying for permit from Registering Authority in Ministry of Overseas Indian Affairs is available online for FEs, who wish to recruit Indian workers directly. FEs can do so after getting registered in the eMigrate system with immediate effect.
