To regulate overseas employment especially for protection of less educated blue collar workers, the Emigration Check Required process is regulated through a unique computerised system called “e-Migrate”. This is a system which is integrated with the Passport Sewa Project of the Ministry of External Affairs and Bureau of Immigration of the Ministry of Home Affairs onone-hand and the Indian Missions in the 18 ECR This ensures that all Stakeholders of the emigrants are on the same electronic-platform, which greatly enhances the “Ease-of-doing-business” and ensures prompt and easy action on all fronts to all the Stakeholders. Whenever an emigrant arrives at an airport or check-post to proceed abroad, his Passport details are validated online by the Immigration Officers and only those who have obtained Emigration Clearance are allowed to travel. This is a measure to ensure protection against possible exploitation, of the Indian workers.

The eMigrate website is under upgradation. At present, it may be accessed through following browser versions /configurations –

  • To have a valid permission for employment of foreign workers from KDN or other approved Malaysian authorities.

  • After emigration clearance, departure of the workers to destination country begins

  • Normally, its KDN, Government of Malaysia which approves the quota for foreign workers in respect of an employer.

  • Once an employer submits complete documents physically at the High Commission of India, it normally takes a week to process the documents and to approve the Login credentials for the employer.
  • The employer may also authorize any other responsible official from his/her company to submit the documents at the High Commission on his/her behalf. An authority letter on company’s letter head along with the photo ID of such authorized comapny official will be required.

  • Pravasi Bharatiya Sahayata Kendra (PBSK), is a welfare initiative of Government of India to provide support to Indian expatriates in need

  • Please contact the desired Indian Recruiting Agent with your requirement vis-à-vis job roles, linguistic /educational /experience /specific skill requirement. It is recommended that you should approach only registered active Indian recruiting agents for such process so that in case of any issue you may raise complaints too through the portal.

  • It is a mandatory insurance scheme aimed at safeguarding the interests of Indian emigrant workers falling under Emigration Check Required (ECR) category going for overseas employment to ECR countries. Malaysia is one of the ECR countries. It is well integrated within the portal itself. For more details, please Click here.
  • Yes. The Malaysian employer will be required to give power of attorney (PoA) to these Indian recruiting Agents for the number of workers that he desires to hire through them. At the time of raising the demand through the eMigrate portal, the employer needs to upload the PoA for specific IRA ID at a time.

  • In such cases, following would be required:

    i. an affidavit from the worker that he has no objection to employer getting replacement in lieu of himself/herself,

    ii. A No objection Letter from the authorized Indian Recruiting Agency to whom PoA was given.

    iii. A government document to support the reason e.g. health certificate etc.

  • Emigration Act, 1983 provides that no citizen of India shall migrate unless he obtains emigration clearance from Protector of Emigrants. Similarly, it has been recognized that certain countries (currently 17) do not have strict laws regulating the entry and employment of foreign nationals. They also do not provide avenues for grievance redressal. Thus they have been categorized as Emigration Check Required (ECR) countries. Hence, all persons, having ECR endorsed passports and going to any of the 17 ECR countries for taking up employment require emigration clearance. However, ECR passport holders going to any ECR country for purposes other than employment do not require emigration clearance. No specific mention of ECNR is made on the passports and the ones not endorsed as ECR, automatically belong to ECNR category.

  • Malaysia is included in the ECR countries. Hence, the procedure given above would be applicable to all ECR passport holders leaving from India to Malaysia.
